The Horry County Police Department has asked the FBI and State Law Enforcement Agency to reopen a deadly 2023 road rage shooting case involving a North Myrtle Beach business owner.
Authorities say Weldon Boyd, who owns Bouys on the Boulevard, and Kenneth Williams shot and killed Scott Spivey of Tabor City, North Carolina, during a road rage incident in September 2023.
The case was turned over from the Fifteenth Circuit Solicitor鈥檚 Office to the South Carolina Attorney General鈥檚 Office, and the agency announced months later that it would not prosecute the case. No charges were filed.
This week, HCPD Chief Kris Leonhardt said after questions about the case from the community, the department requested SLED and the FBI review the case.
鈥淲e take the concerns of our community members seriously,鈥 Leonhardt said during a press conference Wednesday.
Leonhardt would not go into details about the case.
"Since I met you all, my biggest thing has been transparency with our community," he said. "So I wanted a full review and that is why I requested it based upon the information we have, which I can't share at this moment because it is under investigation."
Leonhardt聽separately requested SLED to review the investigation on Monday and requested the FBI on Wednesday.
If charges are brought, Leonhardt said SLED or the FBI would be the charging agency.
He would not confirm if the SLED or FBI investigation involved any police department officers.
An FBI spokesperson confirmed that a request was made to review the incident, but the agency could not provide any details.
The original case was turned over to SLED in 2023, and it was previously reviewed by the Attorney General鈥檚 Office. In April 2024, the Attorney General's Office said it would not prosecute the case due to lack of evidence.
The September 2023 shooting happened on Camp Swamp Road near Longs, killing 33-year-old Spivey.
The shooting appeared to be "an isolated incident," the coroner's office reported at the time, and was being investigated by Horry County Police Department immediately after.
An Horry County police report states an officer was dispatched about 6:04 p.m. Sept. 9, 2023, after reports of "shots fired with both parties on scene" at the intersection of Camp Swamp Road and Highway 9 in the Longs area.
The driver of a white Dodge truck said a man in a black Chevrolet truck jumped out and started shooting toward his vehicle, a police report states. The driver told police he shot back and thought the man in the black truck was dead, the report states.
The driver of the white truck and a passenger gave their guns to police at the scene.
Police said the driver's door was open on the black truck, and Spivey showed no signs of life. The report states police discovered a black handgun with the slide locked under his hand.
Though no charges were filed, Spivey鈥檚 sister Jennifer Spivey Foley, a representative of Spivey鈥檚 estate, filed a wrongful death lawsuit against Boyd and Williams.
The lawsuit states Boyd and Williams began to follow Spivey after "some sort of altercation聽occurred between [Spivey] and Boyd and Williams causing Boyd to be enraged and begin to pursue Spivey.鈥
The suit alleges that Boyd and Williams were driving dangerously close to the rear tailgate of Spivey鈥檚 vehicle, leading to Spivey 鈥渂rake checking鈥 the pursuing vehicle.
After around six minutes of pursuit, the lawsuit alleges that Boyd called 911 and told the dispatcher that if he sees Spivey鈥檚 gun again, he鈥檚 going to 鈥渢ake him ... out.鈥
Boyd and Williams answered the lawsuit, saying they acted in self defense, court records state.
When reached by email, Williams' attorney Robert E. Lee gave the following statement: 鈥淚t is Mr. Williams and my understanding that SLED is investigating alleged misconduct by a Horry County Police officer during the investigation into the death of Scott Spivey. It is our understanding that SLED is not reopening the investigation into the death of Scott Spivey. The Personal Representative of Scott Spivey鈥檚 estate, Jennifer Spicey Foley, who is also Mr. Spivey鈥檚 sister, has filed a civil lawsuit against Mr. Williams in the Horry County Court of Common Pleas 鈥 Civil Action No. 2024-CP-26-03798 in which she and her attorneys are seeking millions of dollars. Mr. Williams and I believe that Ms. Foley is taking all the evidence produced to her attorneys in the civil action, twisting it to get the investigation into the death of Mr. Spivey reopened or to prejudice the jury against Mr. Williams to increase future verdict against them by a jury in Horry County."
Lee added that Williams does not know the Horry County Police deputy chief under investigation, and wants to remind the public that Spivey's death was investigated by multiple agencies. Williams "has been cleared by any wrongdoing," Lee said.
That case is pending, with the latest action聽by Boyd asking the court to quash or limit a subpoena for his medical records.

Seems like Boyd and Williams going to get away with murder because they know the right people and people of higher power positions within the political and local police (because the local police didn鈥檛 investigate the incident at all), they drop the ball.
